In a lawsuit filed Monday in a U.S. District Court in Arkansas, Tthe Equal Employment Opportunity Commission (EEOC) accused Kroger Co. of unlawful employment practices in violation of Title VII of the Civil Rights Act of 1964. The complaint alleges that Kroger refused to accommodate two former employees who expressed religious objections to wearing an apron embroidered with a rainbow-colored heart based on their “good faith belief” that the symbol represented advocacy for the LGBTQ community. Title VII prohibits discrimination in the workplace for various reasons including religious beliefs.

On Thursday, by a vote of 8 to 6, an en blanc panel of the 4th U.S. Circuit Court of Appeals upheld a lower court’s decision prohibiting enforcement of the Trump administration’s “Protect Life” rule in Maryland. The Department of Health and Human Services (DHHS) rule prohibits taxpayer-funded family planning clinics in the Title X program from performing abortions or making abortion referrals and requires the physical and financial separation of facilities that provide such services.
