Ohio Legislature Passes Bill Requiring Humane Burial for Aborted Babies

The Ohio legislature passed a bill that would require the bodies of babies killed by surgical abortions to be cremated or buried at the abortion clinic’s expense.
Senate Bill 27 would allow women seeking abortions to decide and confidentially disclose whether they would like the remains of their unborn child to be cremated or buried. Women could opt out of deciding, but the clinic would still have to pick one. And providers would shoulder all costs except in cases in which women want to make their own arrangements. Violations would be a first-degree misdemeanor.
Under current Ohio law, disposal of any fetal remains, including remains from abortions, miscarriages, or embryos in fertility clinics is not regulated other than the requirement that it be done in a "humane" way.
"This legislation is attempting to add structure and policy to this process," said Dayton Right to Life President Margie Christie in submitted testimony. "This legislation strictly addresses the disposition of the remains. It is not infringing on a woman’s right to choose and in no way burdens her choice. The choice has, at this point, been made."
