Court Upholds Ban On Tennessee Heartbeat Abortion Bill
U.S. Court of Appeals HOLDS that Governor Lee's cascading heartbeat to 24 week ban on abortion is UNCONSTITUTIONAL. The state will have 30 days to decide whether to 1) ask the U.S. Supreme Court to grant an appeal, 2) give up and hope SCOTUS reverses Roe in the Dobbs case next June (MS's law), or 3) go back to the trial court and make a Ninth Amendment argument that the 6th Circuit did not consider in its decision, because the state has not yet chosen to make that argument.
