Boy Scouts Files Chapter 11

In the wake of a huge, decades-long sexual abuse scandal, Boy Scouts of America (BSA) has filed for Chapter 11 bankruptcy in Delaware. The filing for bankruptcy this week will require claims made in current lawsuits to be resolved in the bankruptcy court as well as provide a mechanism for other victims to file claims that will also be approved by that court.
It all started to unravel about ten years ago, when BSA lost a $20-million child sexual abuse case. That case revealed the existence of a “perversion file,” a list of those who were barred from being Scout leaders. This file was never made public to local councils, so abuses continued.
The impact of that case was compounded by membership declines that came when BSA began bowing to the LGBT agenda. Specifically, in 2013 BSA decided to allow homosexual boys to participate in the program, in 2015 it started accepting homosexual adult leaders, and in 2017, it opened its group to transgender youth.
Amidst the backdrop of all this drama and secretiveness, Boy Scouts Chief Executive Roger Mosby said in a statement, “We believe the Chapter 11 process—with the proposed trust structure [Victim’s Compensation Trust]—will provide equitable compensation to all victims while maintaining the BSA’s important mission.”
Jim Turley, national chair for Boy Scouts of America, also wrote an open letter this month to victims apologizing for the abuse they suffered while also trying to win back respect by reassuring folks with, “Today, we believe the BSA’s youth safety measures are the strongest and most effective policies found in any youth-serving organization.”
As Seattle-based lawyer Michael Pfau, who has represented more than 300 Boy Scouts victims in 34 states, explained, “You’re talking about tens of thousands of victims. This will be the largest bankruptcy the country has ever seen, and likely one of the largest corporate bankruptcies.”
Meanwhile, the century-old youth organization is going to ride it out with scouting programs continuing during the bankruptcy proceedings.
