Supreme Court delays decision on Mississippi abortion ban for 5th time

Last Thursday, Mississippi Attorney General Lynn Fitch again asked the Supreme Court to review a lower court’s decision on a state law banning most abortions after 15 weeks. The law was blocked by a district court in 2018, and an appeals court judge upheld the ruling in December of 2019, holding that the restriction placed an unconstitutional burden on a woman’s right to terminate an unwanted pregnancy before viability. Mississippi then appealed the case to the Supreme Court.
Massachusetts Lawmakers Move to Legalize Abortion up to Birth, Adding it to State Budget

Next week, the Massachusetts Legislature is set to debate an amendment to the state’s budget that addresses access to abortions up until birth. The amendment to the budget bill would effectively enact the ROE Act, which had earlier stalled in the Legislature’s Joint Committee on the Judiciary.

City of Philadelphia, a case which presents the question of whether a city may exclude a Catholic adoption agency from its foster care system because, in accordance with Catholic teaching, its policy does not allow it to license same-sex couples to be foster parents.
Amicus Brief Filed in 6th Circuit on Abortion Issue

On Thursday, FACT president, David Fowler, filed a friend of the court brief with the U.S. Court of Appeals for the Sixth Circuit in support of the state’s appeal of federal District Court Judge William Campbell’s decision to prevent enforcement of the Governor’s abortion legislation during the trial of the underlying lawsuit. The brief was filed through the Constitutional Government Defense Fund, allied with FACT, on behalf of 33 members of the current General Assembly.
